ORDINANCE AMENDING ORDINANCE NO. 387-87 PRE-ZONING PROPERTY
OWNED BY BRELAND HOMES COASTAL, LLC TO PUD
WHEREAS, the City of Foley, Alabama, adopted Ordinance No. 387-87 on June 15, 1987, ordaining a new Zoning Ordinance and Zoning Map for the City of Foley which has subsequently been amended, and
WHEREAS, the Planning Commission has recommended approval of this pre-zoning, and
WHEREAS, the City of Foley has received a request that specific property within the City be pre-zoned, and the City Council of the City of Foley deems it necessary, for the purpose of promoting the health, safety, morals and general welfare of the City to amend said Ordinance, and
WHEREAS, all requirements to the laws of the State of Alabama, with regard to the preparation of the report of the Foley Planning Commission and subsequent action of the City Council have been met,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FOLEY, ALABAMA while in regular session accepted the following changes:
Section 1. That the official Zoning Map of the City of Foley, Alabama be amended to pre-zone the property to PUD - Planned Unit Development said property description as follows:

PARCEL 1 DESCRIPTION PER INSTRUMENT NUMBER 1205037:
From the Northwest Corner of Section 8, Township 8 South, Range 4 East, run South 1325.13 feet to a point on the West boundary of said Section 8; thence run North 89 degrees 47 minutes East, 1331.8 feet to an iron pin corner marker beside an old fence corner post, (said post being the locally accepted Northwest Corner of the Southeast Quarter of the Northwest Quarter of said Section 8), for the Point of Beginning of the land herein described; From said Point of Beginning run South 89 degrees 23 minutes East, 444.15 feet to an iron pin corner marker; thence run South 00 degrees 22 minutes East, 1322.44 feet to a railroad spike marker in the asphalt pavement of County Highway 20-S; thence run South 89 degrees 41 minutes West, 440.66 feet to a railroad spike marker, 11 feet South of the of the centerline of the existing asphalt pavement of County Highway 20-S; thence run North 00 degrees 31 minutes West, 1329.68 feet to the Point of Beginning. Lot contains 13.46 acres, more or less, right-of-way included, lying in the Northwest Quarter of Section 8, Township 8 South, Range 4 East, Baldwin County, Alabama. Lot is subject to a public road right-of-way over and across the southern end thereof.

SECTION 2: That the official Zoning Map of the City of Foley be revised to indicate this amendment and duly certified by the appropriate municipal officials.
SECTION 3: This Ordinance shall become effective immediately upon its adoption as required by law.
