WHEREAS, The City deems it necessary to establish a maximum axle limit of two (2) axles per commercial vehicle for all lanes of that portion of Little Rock Road and Dailey Lane between Mills Road and County Road 65.
BE IT ORDAINED that the City Council of the City of Foley as follows:
SECTION 1. It is hereby found, established and declared that it is necessary and in the public interest to establish a maximum axle limit of two (2) axles per commercial vehicle for all lanes of that portion of Little Rock Road and Dailey Lane between Mills Road and County Road 65. This prohibition shall not apply to emergency or public utility vehicles operating while on duty.
SECTION 2. It is hereby found, established and declared that the fine for violating the axle limit hereby established shall be Two Hundred and No/100 Dollars ($200) per violation.
SECTION 3. That, pursuant to the police powers given to the City of Foley by Sections 11-40-1 et seq., Code of Alabama, that the limits described in this Ordinance are hereby established, and that the Mayor and City Clerk are hereby authorized and directed to execute this Ordinance and to take all other steps necessary to effectuate the limits hereby established.
