There was a technicality in the previous vacation process whereby the City of Foley Public Facilities Cooperative District were not included in the resolution as to the vacation of the abutting alleyway. The process will need to be re-done to be considered valid.
Body
WHEREAS, the Foley City Council desires to vacate an unimproved alley running east/west north of U.S. Highway 98 between north Cypress Street and North Chicago Street, and
WHEREAS, the purpose for the vacation is to expand the property (Parcel ID#05-54-08-28-3-000-008.000) for economic development, and
WHEREAS, the Foley City Council went through this process but the current landowner for property identified as the City of Foley's was actually owned by the City of Foley Public Facilities Cooperative District and the Council further desires to vacate the unimproved alley way.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:
SECTION 1: Sets a public hearing in accordance with the Code of Alabama, 1975, Section 23-4-2 to consider the vacation of an unimproved alley located east/west and north of Hwy. 98 between North Cypress Street and North Chicago Street.
SECTION 2: Authorizes the notification of all adjacent landowners thirty (30) days prior to the public hearing in accordance with State Code Section 23-4-2.
SECTION 3: This Resolution shall become effective immediately upon its adoption as required by law.
