An Ordinance Setting a Maximum Axle Limit for Kenny Stabler Avenue Between South Juniper Street and East Pride Boulevard

WHEREAS, The City deems it necessary to establish a maximum axle limit of two (2) axles per commercial vehicle for all lanes of Kenny Stabler Avenue Between South Juniper Street and East Pride Boulevard
BE IT ORDAINED that the City Council of the City of Foley as follows:
SECTION 1. It is hereby found, established and declared that it is necessary and in the public interest to establish a maximum axle limit of two (2) axles per commercial vehicle for all lanes of Kenny Stabler Avenue located between South Juniper Street and East Pride Boulevard. This prohibition shall not apply to emergency or public utility vehicles operating while on duty.
Section 2. It is hereby found, established and declared that the fine for violating the axle limit hereby established shall be Two Hundred Dollars per violation ($200.00).
Section 3. That, pursuant to the police powers given to the City of Foley by Sections 11-40-1 et seq., Code of Alabama, that the limits described in this Ordinance are hereby established, and that the Mayor and City Clerk are hereby authorized and directed to execute this Ordinance and to take all other steps necessary to effectuate the limits hereby established.
Section 4. This ordinance shall become effective immediately upon its adoption and publication as required by law.
