WHEREAS, the Alabama Department of Environmental Management (ADEM) regulates the operation and maintenance of underground fuel storage tanks, and
WHEREAS, the City of Foley owns the Foley Municipal Airport which has an aviation fuel system underground, and
WHEREAS, the City installed a 10,000 gallon underground fuel tank at the Municipal Airport in 1981 with minor upgrades occurring in 1995, and
WHEREAS, recent testing showed the existing underground fuel tank to be in noncompliance with ADEM regulations.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:
SECTION 1:       Finds the existing tank requires closure and removal, and begins the process to close and remove the existing tank and develop the specifications required to install an above ground fuel tank system for the Foley Municipal Airport.
SECTION 2:    Approves using Volkert Engineering under Professional Services contract dated April 5, 2010, to develop the design and spectifications in preparation to bid.
SECTION 3:      This Resolution shall become effective immediately upon its adoption as required by law.
