A Resolution Accepting the Transfer of Certain Unopened/Unnamed Rights-of-Ways from Baldwin County

WHEREAS, certain unopened and/or unnamed Rights-of-Ways are located east of the Foley Beach Express and north of Highway 98 inside or abutting the corporate limits of the City of Foley, and
WHEREAS, an accurate description of the Foley Rights-of-Ways, together with a map thereof showing their relationship to the corporate limits of the City of Foley is attached hereto as Exhibit "A" and is to become a permanent part of this resolution, and
WHEREAS, Baldwin County has determined that allowing the City of Foley to take over sole and exclusive ownership, control, management, supervision, regulation, repair, maintenance , improvement, and responsibility for the Foley Rights-of-Ways is in the best interest of Baldwin County as it is in the best interest of the City of Foley.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:
SECTION 1: Approves and accepts the transfer of unopened/unnamed right-of-ways east of the Foley Beach Express and north of Highway 98.
SECTION 2: That the Mayor, City Clerk, and other officers are further authorized and directed to execute, deliver and/or accept such other documents or instruments as may be required in connection with this transfer.
SECTION 3: This Resolution shall become effective immediately upon its adoption as required by law.
