On August 5, 2013 Council approved Resolution 13-0423 setting a public hearing to consider a portion of vacation of right-of-way at 8454 Palmetto Way on Tuesday, September 3, 2013. The publication deadline for the Notice of Public Hearing was inadvertently missed therefore Resolution 13-0423 must be rescinded and a new public hearing date set for Monday, September 16, 2013. The vacation of the portion of right-of-way at 8454 Palmetto Way is to vacate that portion of right-of-way where a brick mailbox is located. Mr. & Mrs. Flowers has submitted the Declaration of Vacation is it is ready to be advertised for four consecutive weeks prior to the public hearing, which is set for Monday, September 16, 2013.

WHEREAS, on August 5, 2013 Council approved Resolution 13-0423 setting a public hearing to consider a portion of vacation of right-of-way at 8454 Palmetto Way on Tuesday, September 3, 2013, and
WHEREAS, the publication deadline for the Notice of Public Hearing was inadvertently missed therefore Resolution 13-0423 must be rescinded and a new public hearing date set for Monday, September 16, 2013, and
WHEREAS, Travis W. and Debra M. Flowers built a new home at 8454 Palmetto Way and also built a brick mailbox, which is in violation of the City's Resolution 1312-98, which enforces removal of masonry mailboxes on the Public right of ways in the City of Foley, and
WHEREAS, Mr. and Mrs. Flowers were notified of the violation, and have submitted a "Declaration of Vacation of that portion of Right-of-Way at 8454 Palmetto Way, Foley, Alabama.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:
