WHEREAS, the Foley Fire Department has purchased and ordered a new 2014 KME Custom Pumper to replace a 1995 E-One Custom Pumper, and

WHEREAS, Brindlee Mountain Fire Apparatus, LLC has proposed a contract to purchase the 1995 E-One upon the delivery and in-service date of the new pumper.

NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:

SECTION 1:                     Declares surplus a 1995 E-One custom fire pumper, inventory tag# 904, VIN# 4EN3AAA81S1005323, and

SECTION 2:    Approves the sale of same to Brindlee Mountain Fire Apparatus, LLC for $50,000 to be deposited in the General Fund.

SECTION 3:                     This Resolution shall become effective immediately upon its adoption as required by law.
