James Randall McPhail requested his property be deannexed from the Legislative Act 2013-230 for his property known as Lot 1 Sandy Creek Acres Subdivision. The Council approved the deannexation under enabling Resolution 13-0490-RES on September 16, 2013 and the a certified copy of the resolution was sent to the Baldwin County Judge of Probate's Office. Judge Tim Russell held a public hearing whereby the owners consented to the deannexation. The Order of Deannexation was completed October 7, 2013.

WHEREAS, on September 16, 2013 the Foley City Council approved Resolution 13-0490-RES approving the reduction of the City's corporate limits as requested by James Randall McPhail for his property known as Lot 1 Sandy Creek Acres Subdivision, and
WHEREAS, a certified copy of the enabling resolution was sent to the Judge of Probate who ordered, adjudged and decreed that the property be deannexed from Foley's corporate limits.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:
SECTION 1: Accepts the Order of Deannexation dated the 7th of October, 2013 thereby deannexing the property owned by James Randall McPhail.
SECTION 2: This Resolution shall become effective immediately upon its adoption as required by law.
