WHEREAS, the Foley Civic Center has nine (9) stage lights that have been replaced (three (3) Park Can lights and six (6) Ellipsoidal lights) that are forty years old and are beyond their useful life and are no longer needed by the Municipal Complex, and
WHEREAS, Section 11-43-56 of the Code of Alabama of 1975 authorized the municipal governing body to dispose of unneeded personal property, and
WHEREAS, Playhouse In The Park, a non-profit organization from Mobile Alabama wishes to purchase the six Ellipsoidal lights for $75.00 each for a total of $450.00 regardless of the working condition of the lights.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:
SECTION 1: Declares nine (9) stage lights that have been replaced (three (3) Park Can lights and six (6) Ellipsoidal lights) as surplus.
SECTION 2: Authorizes the donation of six (6) Ellipsoidal lights to Playhouse In The Park, Mobile Alabama, which is a non-profit organization.
SECTION 3: This Resolution shall become effective immediately upon its adoption as required by law.
