     NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:

     SECTION 1:     Sets a public hearing to consider the rezoning of property owned by Tyler Higginbotham from B-3 (Local Business District) to R-1R (Restricted Residential Single Family). Property is 3+/- acres located north of US HWY 98 and west of Bender Road.

     SECTION 2:     This Resolution shall become effective immediately upon its adoption as required by law.
