James E. Roberts and Kimberly D. Roberts requested their property be deannexed from the Legislative Act 2013-230 for their property known as Lot 2 Sandy Creek Acres Subdivision. The Council approved the deannexation under enabling Resolution 14-0036-RES on February 3, 2014 and the a certified copy of the resolution was sent to the Baldwin County Judge of Probate's Office. Judge Tim Russell held a public hearing whereby the owners consented to the deannexation. The Order of Deannexation was completed February 25, 2014.

WHEREAS, on February 3, 2014 the Foley City Council approved Resolution 14-0036-RES approving the reduction of the City's corporate limits as requested by James E. Roberts and Kimberly D. Roberts for their property known as Lot 2 Sandy Creek Acres Subdivision, and
WHEREAS, a certified copy of the enabling resolution was sent to the Judge of Probate who ordered, adjudged and decreed that the property be deannexed from Foley's corporate limits.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:
SECTION 1: Accepts the Baldwin County Judge of Probate's Order of Deannexation dated the 25th of February, 2014 thereby deannexing the property owned by James E. Roberts and Kimberly D. Roberts .
SECTION 2: This Resolution shall become effective immediately upon its adoption as required by law.
