An Ordinance Approving a First Amendment to IRH Foley, LLC Warranty Deed

WHEREAS, on August 1, 2022, the Foley City Council adopted Ordinance 22-2035, which declared certain real property no longer needed for municipal purposes and authorized the conveyance of the same to IRH Foley, LLC; and
WHEREAS, the City of Foley deeded the real property to IRH Foley, LLC that was recorded on June 12, 2022 by Instrument Number 2073627; and
WHEREAS, the Deed contains certain "Use Restrictions" in paragraph number 1 of the Deed; and
WHEREAS, the City of Foley and IRH Foley, LLC desire to amend the "Use Restrictions" for their mutual benefit; and
NOW THEREFORE, be it ordained by the City Council of the City of Foley as follows:
SECTION 1: Approves the amendment to the IRH Foley, LLC Warranty Deed as stated in the attached First Amendment to Use Restrictions that shall become a permanent part of the Ordinance.
SECTION 2: This Ordinance shall take effect immediately after its publication as required by law, and all resolutions, ordinances, orders, or parts thereof in conflict or inconsistent with any provision herein are, to the extent of such conflict or inconsistency, hereby repealed.
