WHEREAS, TIGER Phases I and II projects had liquidated damage payments from the contractors, and

WHEREAS, ALDOT stated the liquidated damages are to be paid to Volkert, Inc., the engineering consultant for the projects, and

WHEREAS, 75% of the liquidated damage payments are to be paid to Volkert, Inc. for their unbilled man hours as they continued to oversee the construction after the CE&I fund was depleted.
