Set a public hearing to consider the vacation of right of ways on two separate areas of Beck Road.
 
Summary
This request is for right of ways on two separate areas of Beck Road.  If Council chooses to set the public hearing then it would be held on March 16, 2015 with ads running February 11, 18 and 25, 2015 and March 4, 2015 to comply with the advertising requirements.  The adjoining landowners will have to be notified by certified, return receipt USPS 30 days prior to the public hearing, in addition to the utility companies.   After the public hearing is held if the Council chooses to move forward with the vacation a resolution will have to be adopted stating the vacation is in the public's interest and it will be filed in the probate court with a one time publication of the resolution within 14 days of it being adopted.

WHEREAS, the Foley City Council desires to vacate right of ways on two separate areas of Beck Road, and
WHEREAS, the purpose for the vacation is due to the Engineering Department having to reroute/relocate a portion of Beck Road for the ballfields and Coastal Alabama Farmers and Fishermens Market.
NOW, THEREFORE, BE IT RESOLVED by the Foley City Council that:
SECTION 1:      Sets a public hearing on March 16, 2015, in accordance with the Code of Alabama, 1975 Section 23-4-2 to consider the vacation of the two areas of Beck Road.
SECTION 2:      Authorizes the notification of all adjacent landowners thirty (30) days prior to the public hearing in accordance with State Code Section 23-4-2.
