On August 19, 2013 Council approved Resolution 13-0429 setting a public hearing to declare weeds to be a public nuisance and ordering its abatement at 1721 N. Bunner Street. The public hearing was scheduled for September 16, 2013. Under Alabama Code Section 11-67-23, a notice of the public hearing must be sent to the property owner 30 days prior to the public hearing therefore Resolution 13-0429 must be rescinded and a new public hearing date set for Monday, October 7, 2013.

WHEREAS, on August 19, 2013 Council approved Resolution 13-0429 setting a public hearing to declare weeds to be a public nuisance and ordering its abatement at 1721 N. Bunner Street on Monday, September 16, 2013, and
WHEREAS, Under Alabama Code Section 11-67-23, a notice of the public hearing must be sent to the property owner 30 days prior to the public hearing therefore Resolution 13-0429 must be rescinded and a new public hearing date set for Monday, October 7, 2013.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:
SECTION 1: Rescinds Resolution 13-0429 setting a public hearing to declare weeds to be a public nuisance and ordering its abatement at 1721 N. Bunner Street.
SECTION 2: Sets a public hearing for Monday October 7, 2013 to declare weeds to be a public nuisance and ordering its abatement at 1721 N. Bunner Street.
SECTION 3: This Resolution shall become effective immediately upon its adoption as required by law.
