A Resolution Approving a Capital Project using Restricted Court Cash from the MCJAF Fund.

Body

WHEREAS, the State Legislature enacted Act 2012-535 (The Act) effective June 21, 2012, establishing a Judicial Administration Fund. 

 

WHEREAS, additional docket fees collected as a result of The Act shall be used by the presiding municipal judge and/or the municipal court clerk for operation of the municipal court; and,

 

WHEREAS, additional bail bonds fees collected as a result of The Act shall be expended at the discretion of the court clerk to support the functions of the office of the clerk and shall not reduce the funds allocated to the court under any local act or other funding mechanism under the law, and

 

WHEREAS, the City adopted Resolution 4995-12 on July 2, 2012, to approve establishing a separate bank account for the Municipal Court Judicial Administration Fund.

 

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FOLEY, ALABAMA, as follows:

 

SECTION 1:   Acknowledges the Municipal Court Judicial Administration Fund checking account (100-1073) balance per the Financial Services Division as of May 7, 2025 is $521,860.63.

 

SECTION 2:   Approves a request of the Presiding Municipal Judge and the Court Clerk to use $9,243.80 from the MCJAF restricted cash fund payable to MITY-LITE, INC. to replace

                              28 courtroom tables within the Foley Justice Center and to amend account 100-1030-6053 Small Tools.

 

SECTION 3:  This Resolution shall become effective immediately upon its adoption as required by law.
