On April 1, 2013 the Council approved setting a public hearing to consider solid waste ordinance amendments. When the item was submitted instead of containing the resolution setting the public hearing the ordinance was submitted in the body of the file instead of being an attachment. The action needs to be rescinded and a new resolution setting the public hearing adopted.

WHEREAS, on April 1, 2013 the City Council approved a resolution setting a public hearing to consider the adoption of solid waste ordinance amendments, and
WHEREAS, the actual resolution adopted contained the ordinance containing the solid waste amendments instead of setting the public hearing, and
WHEREAS, the action needs to be rescinded and a new resolution adopted setting the public hearing.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:
SECTION 1: Rescinds Council action on April 1, 2013 approving the solid waste amendments and approves setting the public hearing for the consideration of same.
SECTION 2: This Resolution shall become effective immediately upon its adoption as required by law.
