AN ORDINANCE CONSENTING TO THE CONVEYANCE OF REAL PROPERTY BY THE UTILITIES BOARD OF THE CITY OF FOLEY TO THE BALDWIN COUNTY BOARD OF EDUCATION.

WHEREAS, the Utilities Board of the City of Foley (“Riviera Utilities”) has by Resolution found and determined that it is in the best interests of Riviera Utilities to convey certain real property to the Baldwin County Board of Education, such property being more particularly identified and described as follows:
Tax Parcel number 05-54-04-17-4-000-0001.011, Pin number 376389 and Tax Parcel number 05-54-04-17-4-000-001.000, Pin number 16116, having the street addresses of 19812 Underwood Road, 19752 Underwood Road, and 19752a Underwood Road, Foley, Alabama, and which is improved with an office building consisting of approximately 36,829 square feet, two warehouse buildings consisting of approximately 25,911 square feet and 13,719 square feet respectively, and an equipment building supporting the two-story office building
(the “Property”); and
WHEREAS, Riviera Utilities has requested that the City Council of the City of Foley consent to sale and disposition of said Property; and
WHEREAS, the City Council of the City of Foley has determined that the sale of said Property is in the best interests of the City of Foley and of Riviera Utilities;
NOW THEREFORE, BE IT ORDAINED by the City Council of the City of Foley on this the 7th day of September, 2021 as follows:
1. That, pursuant to Code of Alabama, Section 11-50-314(a)(10) the City Council of the City of Foley hereby consents to and ratifies the conveyance of the above described Property from Riviera Utilities to the Baldwin County Board of Education upon the terms and conditions negotiated between and agreed to by Riviera Utilities and the Baldwin County Board of Education.
2. That the Clerk is hereby authorized and directed to publish this ordinance in accordance with law and to furnish a certified copy of the same to Riviera Utilities at the soone...
