An Ordinance Declaring Certain Real Property Surplus and No Longer Needed for Municipal Purposes and Authorizing the Sale of the Same

WHEREAS, the City of Foley owns certain real property identified as Parcel #54-09-29-2-000-066.000, PPIN #23968, in Foley, Alabama, and
WHEREAS, the City desires to sell this parcel, consisting of approximately .368 +/- acres, and
WHEREAS, this property is no longer needed for municipal purposes, the City finds that it will serve a public purpose to sell the surplus property at the fair market value for the development of a single-family residence.
BE IT ORDAINED by the Foley City Council as follows:
SECTION 1. That the City Council hereby finds and declares that the following property (the “Subject Property”) is no longer needed for municipal purposes and that it is in the best interest of the City of Foley to market and sell the same in the amount of $45,000.00 plus a 50/50 split with the purchaser of the closing costs:
All of Lot 9, and the East Half of Lot 8, Block 4, of West Foley, as per map or plat thereof recorded in the office of the Judge of Probate of Baldwin County, Alabama, in Map Book 1, page 76.
SUBJECT TO an Oil, Gas and Mineral Lease from Irene Roberts to Amoco Production Company, dated October 10, 1978, and of record in the office of the Judge of Probate of Baldwin County, Alabama, in Real Property Book 40, page 765.
SECTION 2. That, pursuant to Code of Alabama, Section 11-47-20 and applicable law, the Mayor and City Clerk of the City of Foley are hereby authorized and directed to execute, acknowledge, attest and deliver a statutory warranty deed for the Subject Property.
