DESCRIPTION OF TOPIC: (who, what, when, where, why, and how much)
Planning Commission is recommending PDD (Planned Development District) for the initial zoning of multiple parcels (233+/- acres) east of Juniper Street and north of Miflin Road (CR 20) and the rezoning of parcels (278+/- acres) located at the northwest intersection of the Foley Beach Express and Miflin Road (CR 20).

WHEREAS, the Planning Commission recommends the initial zoning be  (Planned Development District) with the following contingencies:
A.)       Foley Beach Express access plan being approved by the City and to a formal agreement from McDonalds that they agree to moving the access road to the Foley Beach Express and confirmation from George Woerner that he agrees to moving the access road and the median cut.
B.)       Balloon and amusement rides and other possible height issues being approved by the Navy.
C.)      Amusement ride portion of the PDD must have a site plan review.
D.)       Documentation/agreement from the owner of the parcels not owned by the applicant prior to Council taking any action.
E.)      Fire Department must sign off and approve the site plan reviews.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:
SECTION 1:      Sets a public hearing for the initial zoning and rezoning of Blue Collar Country to consider Planning Commission's recommendation of  PDD (Planned Development District) .
SECTION 2:      This Resolution shall become effective immediately upon its adoption as required by law.
