A RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE A LEGAL SERVICES AGREEMENT WITH RILEY & JACKSON, P.C. AND AFFILIATED CO-COUNSEL FOR THE INVESTIGATION AND PROSECUTION OF CLAIMS RELATING TO THE FIRE APPARATUS MANUFACTURER ANTITRUST LITIGATION

 

Body

 

WHEREAS, the City has been advised of potential claims arising from alleged anticompetitive conduct involving certain manufacturers of fire apparatus and industry associations; and

 

WHEREAS, the City Council finds that it is in the best interest of the City to investigate such potential claims and, if appropriate, pursue recovery on behalf of the City; and

 

WHEREAS, the City desires to retain Riley & Jackson, P.C., together with affiliated co-counsel identified in the Legal Services Agreement, to provide such legal services;

 

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FOLEY, ALABAMA, while in regular session, as follows:

 

Section 1. The Mayor is authorized to execute, on behalf of the City, the Legal Services Agreement with Riley & Jackson, P.C. and affiliated co-counsel for the investigation and, if warranted, prosecution of claims relating to the Fire Apparatus Manufacturer Antitrust Litigation, including claims against certain manufacturers of fire apparatus and industry associations.

 

Section 2. The Mayor, City Clerk, and other appropriate City officials are authorized to execute any additional documents necessary to carry out the intent of this Resolution.

 

Section 3. This Resolution shall become effective immediately upon its adoption.
