AN ORDINANCE PERTAINING TO THE POLICE JURISDICTION OF THE CITY OF FOLEY AND THE SERVICES TO BE PROVIDED THEREIN

Body
WHEREAS, Code of Alabama, Section 11-40-10, as recently amended, made certain changes to municipal police jurisdictions; and
WHEREAS the City Council of the City of Foley has found and determined that it is in the best interests of the City, and it will serve the public benefit and advance the general welfare of the City and the area surrounding it, for the City to establish and operate in its police jurisdiction as set forth herein;
NOW THEREFORE, be it ordained by the City Council of the City of Foley as follows:
1. Police Jurisdiction Limits. That the police jurisdiction outside the corporate limits of the City of Foley shall extend to and cover all adjoining territory within 1.5 miles of the corporate limits.
2. Police Jurisdiction Services. That the City of Foley, and its various departments and agencies, shall provide the following municipal services in the areas of its police jurisdiction which are located outside of the corporate limits of the City of Foley: (1) fire protection and fire inspection services; (2) parks and recreation services; (3) police protection and police services but only when responding in a secondary capacity or pursuant to a mutual aid agreement (Foley Police Department is not the primary law enforcement agency in the police jurisdiction outside the City limits).
3. That the police jurisdiction limits and the services to provided therein are subject to, and are limited by, Code of Alabama, Section 11-40-10 as well as other applicable local and general laws that may curtail the City of Foley’s police jurisdiction limits to something less than those stated herein or that may limit the services which the City of Foley is al...
