Set a public hearing for the Initial Zoning for proposed zoning of properties located along Highway 98 included in the proposed Legislative Annexation

DESCRIPTION OF TOPIC: (who, what, when, where, why, and how much)
At this time the Legislative Annexation has not been completed. The Legislature will still be meeting at 2:00 p.m. on April 1st, April 3rd and April 7th. Alabama State Law allows for pre-zoning of properties going through this process. If the Bill does not pass through the Legislature then the zoning is a mute point; however, if the Bill does pass then the adopted zoning will go into effect the day the Act is in effect. At this time we need to start the process at Council level by setting a public hearing.

WHEREAS, the City of Foley has submitted a Legislative Annexation to the House of Representative and Senator, and
WHEREAS, at this time the HB 582 passed the House and has had a first reading in the Senate, and
WHEREAS, upon anticipation of the Bill being passed through the Senate and being signed into law by the Govenor the Planning Commission has held their public hearings and meetings for proposed zoning of the parcels, and
WHEREAS, the initial zoning, with the exception of PPIN #36830 is being changed from the proposed B-3 to R-1A, will move forward with the process, and
WHEREAS, if the Bill does not get passed then the parcels will stay in the County with County zoning or as unzoned territory.
