WHEREAS, the City of Foley, Alabama will be conducting a municipal election on Tuesday, August 26, 2025, and if required, a runoff election on September 23, 2025, and

 

WHEREAS, the State of Alabama Code 1975, Section 11-46-57 provides that the City Clerk or other officer performing the duties of the Clerk, as the case may be, shall perform the duties of absentee elections manager as provided in Chapter 11 of Title 17 Code of Alabama 1975, and

 

WHEREAS, the State of Alabama Code 1975, Section 11-46-37 provides that in the event the Mayor of any city is a candidate in any municipal election he shall be disqualified to perform the duties set forth in Section 11-46-36, and those duties shall be performed by a disinterested person appointed by the governing body of the city, and

 

WHEREAS, typically those duties of the Mayor fall to the Clerk since Section 11-46-57 names the Clerk to perform election duties not assigned to the Mayor, and

 

WHEREAS, Mayor Hellmich has made it known that he intends to run for office of Mayor in the 2025 Municipal Election.

 

     NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:

     SECTION 1:     Appoints Kathryn Taylor, City Clerk as the Absentee Elections Manager pursuant to Section 11-46-57, Code of Alabama and shall be paid as specified under Ordinance 1051-08 pursuant to Section 17-11-14, Code of Alabama, 1975.

 

     SECTION 2:     Appoints the City Clerk as the Elections Manager as set forth pursuant to State of Alabama Code 1975, Section 11-46-37.

 

     SECTION 3:     This Resolution shall become effective immediately upon its adoption as required by law.
