A RESOLUTION AUTHORIZING GRANTING OF AN ELECTRIC LINE RIGHT-OF-WAY EASEMENT TO BALDWIN EMC

 

 

Body

WHEREAS, the City of Foley, Alabama, is the owner of certain real property located in Baldwin County, Alabama; and

 

WHEREAS, Baldwin Electric Membership Corporation (Baldwin EMC) has requested the grant of an electric line right-of-way easement across a portion of said City-owned property for the purpose of constructing, operating, maintaining, repairing, replacing, and upgrading electric transmission and distribution facilities; and

 

WHEREAS, the location and extent of the proposed electric line right-of-way easement are depicted on a map attached hereto as Exhibit “A”, which is incorporated herein by reference; and

 

WHEREAS, the City Council of the City of Foley has determined that granting said easement, as shown on Exhibit “A,” is in the best interest of the City and will not adversely affect the present or future municipal use of the property.

 

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FOLEY, ALABAMA, AS FOLLOWS:

 

SECTION 1: The City Council hereby approves the grant of an Electric Line Right-of-Way Easement to Baldwin Electric Membership Corporation across the City-owned property, the location of which is shown on Exhibit “A” attached hereto and made a part hereof.

 

SECTION 2: The Mayor is hereby authorized and directed to execute the Electric Line Right-of-Way Easement, together with any exhibits referenced therein, on behalf of the City of Foley, Alabama, and to take such further actions as may be necessary to carry out the intent of this Resolution.

 

SECTION 3: This Resolution shall become effective immediately upon its adoption.
