Vacation Of Unimproved Alley Way Running East/West North of Highway 98 Between the East side of Chicago Street and the West Side of North Cypress Street, more particularly described on Exhibit "A".

WHEREAS, the City of Foley wants to vacate an unimproved alley way running East/West North of Highway 98 between the East side of Chicago Street and the West side of North Cypress Street, and
WHEREAS, the purpose of the vacation is to expand the property (Parcel ID# 05-54-0828-3-000-008.000) for economic development, and
WHEREAS, pursuant to Section 23-4-2 of Code of Alabama 1975, notice of said request for vacation was published and a hearing was held on the 17th day of March, 2014, and
WHEREAS, proper notice of said request for vacation was given to the following adjacent property owners:
George Wallace, PIN # 036909
Michele Pak, PIN # 033509
City of Foley Public Facilities Cooperative District PIN # 077283
Denson Freeman, PIN #s 066412, 025070 and 009994, and
WHEREAS, it appears to the Council of the City of Foley, Alabama that the vacation of said alley way is in order and that convenient and reasonable means of ingress and egress is afforded to all other property owners owning properties that adjoin the alley way, and
WHEREAS, it is in the interest of the public that the said alley way be vacated.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:
SECTION 1: The vacation of the hereinabove described alley way is assented to and approved and same is hereby vacated pursuant to the provisions of Section 23-4-20 of the Alabama Code of 1975.
