Glenlakes subdivision was annexed into the corporate limits of the city of Foley by Legislative Act No. 2002-461. The initial zoning ordinance, Ordinance 740-02 and the legal description "Exhibit A" was adopted on October 21, 2002. The legal description did not exclude PPIN#s 202407, 202406 and 120236. Therefore, Ordinance 740-02 must be amended to exclude those parcels.

 

 

Body

WHEREAS, Glenlakes subdivision was annexed into the corporate limits of the city of Foley by Legislative Act No. 2002-46, and

WHEREAS, the initial zoning ordinance, Ordinance 740-02 and the legal description "Exhibit A" was adopted on October 21, 2002, and

WHEREAS, although the annexation did not include three parcels ( PPIN: 202407, 202406 and 120236), the initial zoning ordinance, Ordinance 740-02 did not exclude them in the legal description.

 

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FOLEY ALABAMA, AS FOLLOWS:

 

SECTION 1:                     Amends the legal description attached hereto as "Exhibit A" to include the following:

 

                     "LESS AND EXCEPT that real property located in Lots 1 and 2 of Dune Estates (PPIN#s 202407 and 202406 ) as recorded on Slide 1535-B, Baldwin County Probate Records".

 

SECTION 2:    This ordinance shall become effective upon its publication as required by law.
