WHEREAS, the City Council has conducted a public hearing Monday, August 20, 2012 at 5:30 p.m. to hear objections and other public comment on the matter of declaring the growth of weeds, grass and other vegetative growth on property located within the City of Foley at 405 S. Poplar Street , Tax Parcel ID #05-54-08-28-3-000-088.035, 426 W. Peachtree Avenue, Tax Parcel ID #05-54-04-17-4-000-012.030, 318 W. Orange Avenue, Tax Parcel ID #05-54-09-29-4-000-013.000 and 231 Woodson Drive, Tax Parcel ID #05-54-09-29-3-000-025.014, a public nuisance as provided in the State of Alabama Code.

NOW, THEREFORE BE IT RESOLVED by the City Council of Foley, meeting this 20th day of August, 2012 that the condition of the property described in this resolution is declared a public nuisance and the abatement of this public nuisance is hereby ordered.

BE IT FURTHER RESOLVED that City forces and/or contractors the City may hire are ordered to enter upon the property for the purpose of abating the public nuisance.

BE IT FURTHER RESOLVED that a complete record of the cost of abating the nuisance shall be kept and a total cost shall be rendered to the City Council at a meeting following the work...
