WHEREAS, the Foley City Council, June 21, 2010, accepted Emerald Waste Services, Inc.'s extension of the original contract for commercial solid waste services for a period of three (3) years (Resolution #4132-10), and,
WHEREAS, that extension expires June 21, 2013, and,
WHEREAS, Waste Pro of Florida, Inc. had purchased Emerald Waste Services effective April 1, 2011 and in connection with this sale, Emerald Waste assigned the contract and all of its related rights, obligations and interests to Waste Pro, and,
WHEREAS, Waste Pro has offered to extend our current Commercial Solid Waste Agreement for an additional three (3) years with an effective date of June 1, 2013, and,
WHEREAS, Waste Pro, in addition to the offer to extend the contract, has agreed to forfeit any increases allowed through the duration of the agreement.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:
SECTION 1:      Extends Waste Pro's current Commercial Solid Waste agreement for a period of three (3) years.
SECTION 2:      This Agreement will become effective on June 1, 2013 at the prices currently in place and will terminate on May 31, 2016.
SECTION 3:      This Resolution shall become effective immediately upon its adoption as required by law.
