ORDINANCE AMENDING ORDINANCE NO. 387-87 REZONING PROPERTY OWNED BY Jim Brown FROM R3, Residential Multi-Family TO PUD, Planned Unit Development.

Body
WHEREAS, the City of Foley, Alabama, adopted Ordinance No. 387-87 on June 15, 1987, ordaining a Zoning Ordinance and Zoning Map for the City of Foley which has subsequently been amended, and

WHEREAS, the City of Foley has received a request that specific property within the City be re-zoned, and the City Council of the City of Foley deems it necessary, for the purpose of promoting the health, safety, morals and general welfare of the City to amend said Ordinance, and

WHEREAS, all requirements to the laws of the State of Alabama, with regard to the preparation of the report of the Foley Planning Commission and subsequent action of the City Council have been met, and

WHEREAS, the City Council needs to set a public hearing to be held prior to the second reading of the ordinance.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FOLEY, ALABAMA, while in regular session Monday, June 1, 2015, as follows:

SECTION 1: Sets a public hearing to be held prior to the second reading of this ordinance.

SECTION 2: That the official Zoning Map of the City of Foley, Alabama be amended to rezone the portion of property previously zoned R3, Residential Multi-Family to PUD, Planned Unit Development; said property description as follows:

Tax Map No. 05-61-02-10-0-000-004.008, PIN No. 80884, Intending to Describe:
Commencing at the Northwest corner of Section 10, Township 8 South, Range 4 East, Baldwin County, Alabama, run South 89°-22'-38" East, along the North boundary of said Section, a distance of 1327.50 feet; thence South 00°-25'-42" East, 60.00 feet to a rod and cap (Polysurveying) set on the South right-of-way line of County Road 20, as established by a deed to the City of Foley, Alabama, recorded as Instrument No. 1033397 in the Office of the Judge of Probate, Baldwin County, Alabama, and the Po...
