WHEREAS, the City has undertaken the extension of Pride Drive and widening of Juniper Street from CR 20 to Tammany Boulevard, and
WHEREAS, certain utility relocations are required as part of this project, and
WHEREAS, Baldwin EMC is responsible only for collecting the cost related to the "in-kind" portion of the utility relocation by using the ATRIP reimbursement process.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:
SECTION 1: The City of Foley shall reimburse Baldwin EMC for all costs arising from any betterment of utilities relative to the referenced project, City account/project 12-665-7311 Q88, CONST.
SECTION 2: This Resolution shall become effective immediately upon its adoption as required by law.
