WHEREAS, the City Council passed Resolution No. 13-0014 on October 1, 2012 approving Baldwin County Commission and Baldwin County Highway Department to apply for ATRIP Phase II funding, and the City's participation in the project if approved by the State, and
WHEREAS, the City Council passed Resolution No. 13-0241 on April 1, 2013 approving an Intergovernmental Service Agreement with Baldwin County which has been revised causing the need for 13-0241 to be rescinded, and
WHEREAS, there is a need to appropriate funding up to $263,672, plus one-half of the utility relocation costs and any project overruns, and enter into an amended Intergovernmental Service Agreement with the Baldwin County Commission.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:
SECTION 1: Rescinds Resolution 13-0241 and voids the first Intergovernmental Service Agreement from the County.
