 An Ordinance to Reduce the Speed Limit on County Road 65.

 

Summary

DESCRIPTION OF TOPIC: (who, what, when, where, why, and how much) Due to increased traffic and noise along County Road 65 associated with increased growth in population, a need has arisen to lower the speed limit to 35mph.

Body

WHEREAS, the City deems it necessary to set standards for design and construction requirements, guidelines, details and standards for the design, development and construction relating to residential, commercial or industrial development within the jurisdiction

 

WHEREAS, due to increased traffic and noise along County Road 65 associated with increased growth in population, a need has arised to lower the speed limit to 35mph, and

 

WHEREAS,  the portion of County Road 65 impacted by this proposed reduced speed limit to 35mph, and

 

WHEREAS, the City deems it necessary to set standards for design and construction requirements, guidelines, details and standards for the design, development and construction relating to residential, commercial or industrial development within the jurisdiction, and

 

WHEREAS, it is permissible for the City to reduce the speed limit per Title 32, Article 8, Section 32-5A-173, Code of Alabama and it will provide a consistent speed limit for the citizens' safety.

 

BE IT ORDAINED that the Foley City Council as follows:

 

Section 1.                     Amends Ordinance 391-87 and approves reducing the current speed limit from 45 mph to 35 mph along the portion of County Road 65.

Section 2.                     "The terms and provisions of this ordinance are severable.  If any part or portion of this ordinance is declared invalid, void, or unconstitutional, that portion shall be deemed severed, and the remaining portions of the ordinance shall remain in full force and effect."

Section 3.                     All ordinances or parts of ordinances, in any manner conflicting herewith are hereby repealed.

Section 4.                     This ordinance shall become effective upon its publication as required by law.
