     NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:

     SECTION 1:     Sets a public hearing to consider the rezoning of property requested by Phil Noonan from B-1A (Extended Business District) to R-3 (Residential Multi-Family).

Property is 43.2+/- acres located south of County Road 12 and west of the Foley Beach Express.

     SECTION 2:     This Resolution shall become effective immediately upon its adoption as required by law.
