WHEREAS, during the regular scheduled Council Meeting on May 3, 2021, Council adopted Resolution 21-1138 A RESOLUTION REVOKING BUSINESS LICENSE FOR RODNEY SCHRIMPSHIRE/SEMMES TOWING & RECOVERY LLC AT 19891 COUNTY ROAD 10 A; FOR VIOLATIONS OF STATE CODE AND COMPLAINT FROM CITIZEN,

WHEREAS, the revocation of the business license was a result of violations of State Code and a complaint from a citizen regarding damaged vehicle and lack of professionalism, all in relation to business activity as well as felony charges in Mobile County, and

WHEREAS, on March 7, 2022, the City of Foley received an email from Mr. Schrimpshire's Attorney J. Michael Newton containing a Business License Application for SEMMES TOWING & RECOVERY with the owners listed as Rodney and Cheryl Schrimpshire, and

WHEREAS, during the regular scheduled Council Meeting on March 21, 2022, Council adopted Resolution 22-1095 denying the Business License Application, and

WHEREAS, on March 24, 2022, the City of Foley Revenue Department received written notice from Attorney J. Michael Newton and on behalf of Rodney and Cheryl Schrimpshire of their desire to appeal City Council's denial, and

WHEREAS, a Public Hearing was held on April 4, 2022 to discuss matters related to this appeal.

 

     NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:

     SECTION 1:     Denies the Business License Application filed by Attorney J. Michael Newton, on behalf of Rodney and Cheryl Schrimpshire for Semmes Towing & Recovery LLC.

     SECTION 2:     This Resolution shall become effective immediately upon its adoption as required by law.
