A RESOLUTION AUTHORIZING THE ACCEPTANCE OF CERTAIN REAL PROPERTY

 

Body

 

WHEREAS, on or around May 3, 2024, the City of Foley Planning Commission accepted the Final Plat of Hadley Village, a Planned Unit Development;

 

WHEREAS, the final plat illustrated property set aside for a future pedestrian path and this property was identified as Parcel “A” on the final plat;

 

WHEREAS, Parcel “A” was to be conveyed to the City of Foley for a future pedestrian path at the time of recording the final plat;

 

WHEREAS, the final plat was recorded on May 3, 2024, as Slide No. 0002946 and Instrument No. 2122027 in the records of the Baldwin County Judge of Probate;

 

WHEREAS, Parcel “A” was assigned Parcel ID #83217 by the Baldwin County Revenue Commissioner and Robertson Construction Company, LLC, continues to own the property;

 

WHEREAS, Robertson Construction Company, LLC, desires to donate Parcel “A” to the City in accordance with the conditions of the final plat approval and the City desires to acquire and accept the property from Robertson Construction Company in accordance with these certain terms, conditions, and understandings; and

 

WHEREAS, the City finds that this transaction will serve a public purpose;

 

NOW, THEREFORE, be it resolved by the City Council of the City of Foley at its meeting on the 20th day of January, 2026 as follows:

 

That the Mayor, City Clerk, and other municipal officers, or any one or more of them, are hereby authorized and directed to do execute such documents as are necessary or required to acquire and accept Parcel “A” of the Hadley Village Subdivision.

 

That all prior actions taken by any elected or appointed officers or by any employees or agents of the City of Foley in connection with the acquisition and acceptance of Parcel “A” as described herein are hereby ratified and affirmed.
