A RESOLUTION TEMPORARILY SUSPENDING THE ENFORCEMENT OF THE ZONING CODE AND OTHER MUNICIPAL CODES THAT PROHIBIT THE OCCUPANCY OF RECREATIONAL VEHICLES
WHEREAS, there are zoning and other municipal codes which prohibit or restrict the use of recreational vehicles as occupied dwellings or residences in certain parts of the City of Foley; and
WHEREAS, Hurricane Sally has caused many homes, apartment complexes, and other dwellings to be uninhabitable or in need of repair; and
WHERAS, a very large number of residents of the City of Foley are being displaced from their dwellings, and there are insufficient numbers of replacement dwellings for all of these people; and
WHEREAS, the City of Foley wants to minimize the disruption to its residents and to do what it can to accommodate people who are in immediate need of new housing options in the City of Foley while the housing and apartments are being repaired and renovated;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Foley, Alabama, as follows:
Section 1. That all City employees and agents are hereby, for a period of six (6) months, temporarily prohibited and restricted from enforcing any zoning code and other municipal ordinances that would prohibit or restrict occupancy in recreational vehicles in any zoning district or area in the City of Foley, provided, however, that only one (1) recreational vehicle can be located on a parcel of land. Such recreational vehicles may be hooked up to temporary power, sewer, and other utilities. The temporary suspension of enforcement of the zoning and other codes will be for six (6) months only, and the temporary suspension of enforcement will automatically expire without further action from the Council.
