Summary
The Environmental Department requests an amendment to the Land Development Ordinance No. 22-2028 Article 3.3-6 fifth paragraph to the following: Redevelopment sites that modify over 50% of the valuation of the property or the structure (whichever is least restrictive) AND modify any exterior impervious surface shall increase the capture and retaining of stormwater runoff (with the goal of the first 1.25 inches) from impervious areas through LID and GI practices including infiltration, evapotranspiration or reuse on site. This provision shall allow an exemption for properties zoned B1.

WHEREAS, the Land Development Ordinance No. 22-2028 was adopted on June 6, 2022, and
WHEREAS, Article3.3-6 has requirements that would place a hardship on redevelopment within the B1 Zoned areas.

BE IT ORDAINED that the Foley City Council as follows:

Section 1. Amends the Land Development Ordinance No. 22-2028, Article 3.3-6 fifth paragraph to the following: Redevelopment sites that modify over 50% of the valuation of the property or the structure (whichever is least restrictive) AND modify any exterior impervious surface shall increase the capture and retaining of stormwater runoff (with the goal of the first 1.25 inches) from impervious areas through LID and GI practices including infiltration, evapotranspiration or reuse on site.
