An Ordinance to Impose a Temporary  Moratorium on Land Disturbance Permits

 

Summary

In conjunction with the proposed Land Development Ordinance, Environmental and Engineering Departments requests an ordinance imposing a temporary moratorium on land development permits until the ordinance becomes law. The request does not affect permits that have already been received by the Departments and are under review or are approved. There is a condition to allow Land Disturbance Permits if the applicant meets all the new requirements of the proposed Land Development Ordinance. The moratorium would be in effect until the public hearing of the ordinance and publication, at which time moratorium will expire.

 

Council may choose to suspend the rules.

 

 

Body

 

     WHEREAS, the City of Foley Land Development Ordinance was developed to address increased engineering and environmental standards for developments, and

     WHEREAS, the ordinance adoption process may take up to two months to become law, and

     WHEREAS, the City of Foley does not want Land Disturbance Permits issued under the previous development ordinances while the new laws are being adopted, and

     WHEREAS, developments that wish to apply for a Land Disturbance Permit following all the new requirements of the proposed Land Development Ordinance may be considered during the moratorium.

     NOW THEREFORE BE IT Ordained that the City Council of the City of Foley, Alabama, as follows:

     SECTION 1:     Imposes a temporary moratorium on applications for a Land Disturbance Permit if not already in the review process unless the permit application package meets all the requirements of the new Land Development Ordinance. This moratorium shall be effective immediately and will expire upon the adoption and publication of the new Land Development Ordinance.

     SECTION 2:     This Ordinance shall become effective immediately upon its adoption as required by law.
