WHEREAS, the Alabama Department of Environmental Management (ADEM) has determined that the underground fuel storage tank at the Foley Municipal Airport requires closure and removal as per Resolution 13-0232, and,
WHEREAS, Volkert Inc. has submitted Volkert Proposal 13-P0408 for professional services related to the removal and closure of the underground storage tank (UST) at the Foley Municipal Airport in an amount of $23,975.00 based on a "clean" UST closure.  (If the site is contaminated, a new estimate may be required.)
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:
SECTION 1:      Accepts Volkert Proposal 13-P0408 for the scope of services listed in the letter agreement dated May 2, 2013 in an amount up to $23,975.00 and amends 12-665-7323, R01, VLKUST and,  
SECTION 2:      This Resolution shall become effective immediately upon its adoption as required by law.
