WHEREAS, the City of Foley plans to make certain improvements at the Foley Municipal Airport; and,
WHEREAS, the State of Alabama, acting by and through the Alabama Department of Transportation (ALDOT) has certain funding and financial assistance programs that can help finance improvements at the Foley Municipal Airport.
WHEREAS, the planned project is to construct a new 10-unit T-Hangar building.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:
SECTION 1: That the City of Foley is hereby authorized to make application to ALDOT by submittal of both the initial pre-application and the grant application for airport improvement funding assistance for the purpose of undertaking an airport project in ALDOT FY26 and City of Foley FY27.
SECTION 2: That either the Mayor or the Airport Manager of the City of Foley are hereby each authorized, directed, and empowered to apply for and to enter into an airport improvement funding agreement with the State of Alabama, acting by and through the Alabama Department of Transportation, including all understandings and assurances contained therein, and to each act in connection with the application and agreement and to provide such additional information as may be requested.
SECTION 3: That the authority of the City of Foley to enter into contracts with the State of Alabama has been reviewed by the City of Foley attorney, and in his opinion, the City of Foley is duly authorized to commit the City of Foley to an agreement with ALDOT.
SECTION 4: That the City of Foley hereby affirms that the local matching share of the money required to complete the project will be officially approved, placed in the budget, and available for expenditure upon execution of the State of Alabama’s funding agreement that includes the project budget, prior to the commencement of this project.
SECTION 5: This Resolution shall become effective immediately upon its adoption as required by law.
