A Resolution to Memorialize Approval of Change Order Number 1 to Roy Lewis Construction Corporation related to construction of the First Responder’s Safe Room
Summary
A New First Responder's Safe Room for the City of Foley is currently under construction on North Poplar Street with completion expected in mid-2027. Roy Lewis Construction Corporation is the general contractor for the project. The Utilities Board of the City of Foley, doing business as Riviera Utilities, will provide domestic water, sanitary sewer, electrical, and natural gas services to the new Safe Room. During review of the various project construction submittals, the architect of Record and the Engineer of Record, and City staff, in coordination with Riviera Utilities, determined that additional improvements are required for the site in order to protect existing water mains as well as provide additional fire protection to the site. The staff of the City of Foley recommends to Council to memorialize approval by Mayor Ralph G. Hellmich of Change Order Number 1 in the amount of $175,503.23. Funds for the Safe Room project were appropriated under HMPG 24-1208-RES.

WHEREAS, the new City of Foley First Responder's Safe Room (facility), currently under construction, will be complete in mid-2027; and
WHEREAS, the Utilities Board of the City of Foley (Riviera Utilities) will provide water, sewer, natural gas, and electrical services to the new facility; and
WHEREAS, The Architect of Record, Engineer of Record, City staff, and Riviera Utilities have discovered additional improvements are needed to protect existing infrastructure as well as provide added fire protection to the site for which a contract change order is required; and
WHEREAS, the staff of The City of Foley recommends to Council to memorialize approval by Mayor Ralph G. Hellmich of Change Order Number 1 to Roy Lewis Construction Corporation in the amount of $175,503.23; and
WHEREAS, the staff of The City of Foley further memorializes the $175,503.23 cost of Change Order Number 1 is eligible for reimbursement through the Federal Emergency Management Agency (FEMA).
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:
SECTION 1: Authorizes Change Order Number 1 in the amount of $175,503.23 to Roy Lewis Construction Corporation related to additional utility and public safety improvements for the First Responder's Safe Room currently under construction on North Poplar Street.
SECTION 2: Memorializes the approval by Mayor Ralph G. Hellmich of the Change Order Number 1 AIA Change Order document and appropriate $175,503.23 as funded by account number 400-9200-5100 S03.1
SECTION 3: This Resolution shall become effective immediately upon its adoption as required by law.
