WHEREAS, the City of Foley rendered to the City of Robertsdale on December 20, 1993; certain property formally known as the L&N Railroad Property that was within the city limits of the City of Robertsdale, and
WHEREAS, it has been found that there are additional parcels of property deeded to Louisville & Nashville RR, c/o CSX Transportation, Inc., that adjoin the property given to the City of Robertsdale in the 1993 transfer by the City of Foley, and
WHEREAS, the City of Robertsdale is requesting permission from the City of Foley to proceed in securing said adjoining properties, which are held in title by Louisville & Nashville RR, c/o CSX Transportation, within the city limits of the City of Robertsdale that adjoins the property transferred to the City of Robertsdale by the City of Foley in 1993, and
WHEREAS, CSX Transportation has given in their letter of October 12, 2011, that they do not hold said property and would not object to the City of Robertsdale taking legal action in securing claim of said properties.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:
SECTION 1: Approves the City of Robertsdale to proceed with their request in securing title of said properties.
SECTION 2: This Resolution shall become effective immediately upon its adoption as required by law.
