There is a request for Council to suspend the rules of having a first and second reading for immediate adoption of this ordinance to amend Ordinance 13-1034.
 
 
Body
      WHEREAS, Ordinance 13-1034 was passed by Council on July 1, 2013 and is to be effective October 1, 2013, and
 
      WHEREAS, Section 4. B For Required Service has a portion that was inadvertently omitted.  The adopted section reads as follows:
      Section 4. For Required Service
      B. All mobile home parks and all apartment complexes containing over four (4) dwelling units shall be required to subscribe to garbage collection by dumpster services provided through the City of Foley or its contractor except when the City Public Works Department has granted an exception due to space limitations.
      WHEREAS, the portion of the ordinance that was omitted is as follows:  In the cases where exceptions are granted based on space limitations, the owner of the apartment complex or mobile home park shall subscribe to and be financially responsible for all garbage can collection services provided by the City or its contractor.
      BE IT ORDAINED that the Foley City Council as follows:
Section 1.      Amends Ordinance 13-1034, Section 4.B. to read      :
      Section 4.      For Required Service
      B. All mobile home parks and all apartment complexes containing over four (4) dwelling units shall be required to subscribe to garbage collection by dumpster services provided through the City of Foley or its contractor except when the City Public Works Department has granted an exception due to space limitations. In the cases where exceptions are granted based on space limitations, the owner of the apartment complex or mobile home park shall subscribe to and be financially responsible for all garbage can collection services provided by the City or its contractor.
Section 2.      "The terms and provisions of this ordinance are severable.  If any part or portion of this ordinance is declared invalid, void, or unconstitutional, that portion shall be deemed severed, and the remaining portions of the ordinance shall remain in full force and effect."
Section 3.      All ordinances or parts of ordinances, in any manner conflicting herewith are hereby repealed.
Section 4.      This ordinance shall become effective October 1, 2013.
