WHEREAS, the City deems it necessary to revise the Subdivision Regulations to establish procedures and standards for the development of subdivisions or proposed additions to existing subdivisions within the Corporate limits and the Extra-Territorial Planning jurisdiction of Foley, Alabama, in an effort to regulate the minimum size of lots, the planning and construction of all streets, roads, drainage structures and to require the proper placement of public utilities.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:
Section 1. Adopts the City of Foley, Alabama Subdivision Regulations as adopted by the Planning Commission on March 18, 2015 and submitted by the Planning Commission to be made a part of this resolution upon its adoption.
Section 2. The terms and provisions of this resolution are severable. If any part or portion of this resolution is declared invalid, void or unconstitutional, that portion shall be deemed severed and the remaining portions of the resolution shall remain in full force and effect.
Section 3. All ordinances/resolutions or parts of ordinances/resolutions in any manner conflicting herewith are hereby repealed.
Section 4. This resolution shall become effective immediately upon its adoption as required by law.
