The Alabama Department of Transportation (ALDOT) is the jurisdictional agency with oversight over certain Rights-Of-Ways within the City Limits of Foley and ALDOT has allowed the City of Foley to conduct landscaping, and other maintenance activities on their Rights-Of-Ways under various issued permits. The City of Foley has worked with ALDOT to permit new sidewalk structures including ramps, and retaining walls. This cooperative maintenance agreement will cover existing and future structures installed in an effort to accommodate pedestrian travel along both sides of the ALDOT Right of Way along Route US Hwy 98 and AL 59 within Foley City Limits and the City of Foley is willing to take responsibility for the requested maintenance.

WHEREAS, the Alabama Department of Transportation (ALDOT) is the jurisdictional agency with oversight over certain Rights-Of-Ways within the City Limits of Foley; and
WHEREAS, the ALDOT has allowed the City of Foley to conduct landscaping, mowing, and other maintenance activities on their Rights-Of-Ways under various issued permits; and
WHEREAS, the City of Foley has worked with ALDOT to permit sidewalk structures including ramps, and retaining walls. This cooperative maintenance agreement will cover existing and future structures installed in an effort to accommodate pedestrian travel along both sides of the ALDOT Right Of Way along Route US Hwy 98 and AL 59 within Foley City Limits; and
WHEREAS, ALDOT has deemed it necessary for the City of Foley to enter into a Cooperative Maintenance Agreement (CMA) in order to approve permitting requests associated with the Project.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:
SECTION 1: The City Council acknowledges and supports the ALDOT Cooperative Maintenance Agreement in conjunction with the location.
SECTION 2: The Mayor is hereby authorized to execute any and all documents required to facilitate the Project.
SECTION 3: This Resolution shall become effective immediately upon its adoption as required by law.
