WHEREAS, the Utilities Board of the City of Foley owns a parcel of real property on the northwest corner of Nichols Avenue and Young Street, identified by Tax PPIN 061420 (the Parcel), and
WHEREAS, on March 19, 2019 the Utilities Board of the City of Foley accepted the City of Fairhope's offer to purchase the Parcel, and
WHEREAS, the Board has determined that the Parcel is no longer needed for any business purposes, and
WHEREAS, the Board has determined the Offer to Purchase submitted by Fairhope as acceptable.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:
SECTION 1: That the Offer to Purchase Parcel 061420 dated 02/21/2019, submitted by the City of Fairhope is hereby accepted and the sale of the Parcel is approved.
SECTION 2: Approves the General Manager and CEO of the Utilities Board of the City of Foley to sign the offer to purchase and take such other actions as necessary or appropriate to close the sale, and
SECTION 3: Authorizes the General Manager and CEO of the Utilities Board of the CIty of Foley to take such other actions necessary or appropriate to close the sale of PPIN 061420.
SECTION 4: The terms and provisions of this ordinance are severable. If any part or portion of this ordinance is declared invalid, void, or unconstitutional, that portion shall be deemed severed, and remaining portions of the ordinance shall remain in full force and effect.
SECTION 5. This ordinance shall become effective upon its publication as required by law.
