DESCRIPTION OF TOPIC: (who, what, when, where, why, and how much)
On September 3rd the Council fixed the costs of $104,025.38 for a final assessment against 104 West Laurel Avenue.  Notices were sent to the landowners and their attorneys giving them 30 days notice to either pay the assessment in full or contact the City for repayment in installments.  To date the 30 days has expired and notices from the landowners were returned and the notices to their attorneys were accepted.  The next step is to give notice by publication once a week for three consecutive weeks containing the time, date and location of the sale, the purpose of the sale and the description of the property.  The owners have the opportunity to pay the lien plus interest in full prior to the sale of the property.

WHEREAS, on September 3, 2013 the Foley City Council adopted Resolution 13-0456-RES fixing the costs associated with the nuisance at 118 West Laurel Avenue, and
WHEREAS, and copy of the enabling resolution and a letter was sent to each landowner and their attorneys informing them again of the nuisance violation, the costs to abate the nuisance, which included fixing the costs by the Council as a lien against the property, and the terms for payment and non-payment, and
WHEREAS, the City of Foley received the returned letters from the landowners and the return receipt certificates from the landowners attorneys.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:
SECTION 1:      The City Council authorizes City staff to move forward with giving notice by publication once per week for three consecutive weeks in a newspaper published or of general circulation in the City of the public sale of the property and paying the costs of advertising.  
SECTION 2:      This Resolution shall become effective immediately upon its adoption as required by law.
