BE IT ORDAINED BY THE CITY COUNCIL OF FOLEY, ALABAMA AS FOLLOWS:
Section 1. It is hereby found, established and declared that certain real property generally described below is not presently needed for public or municipal purposes, to-wit:
That certain real property located at 118 West Laurel Avenue which consists of lots 9, 10, 11 and 12 in Block 10 in the City of Foley, Alabama 36535, according to the plat of record in the office of the Judge of Probate of Baldwin County, Alabama in Map Book 1, page 25. Tax Parcel ID Number 05-54-09-29-1-101-014.000 containing approximately .116 acres and consisting of two stories and a total of approximately 10,000/sf (5,000/sf on the lower level formally the Cactus Café Restaurant and approximately 5,000/sf on the upper level formally used as living facilities).
Section 2. It is further hereby found, established and declared that it is in the best interest of the public and the City of Foley, Alabama to sale said real property upon such terms as set forth in the “Request for Proposals” and as the Mayor and legal counsel deem appropriate and acceptable.
Section 3. That the Mayor and the City Clerk are hereby authorized and directed to execute and attest a sales agreement approved by the Mayor and legal counsel and to take any and all other actions they deem necessary or prudent to effectuate the sale of said property.
Section 4. That all prior actions taken by the Mayor, City Clerk, City employees and agents and the City’s legal counsel in connection with the negotiation, execution, and delivery of this Ordinance are hereby ratifies, approved and affirmed.
